Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Foundry, operated by Resurgence Cloud LLC (“Foundry,” “we,” “us,” or “our”). By creating an account or using the platform, you agree to these Terms.

1. The service

Foundry is a multi-tenant business platform that lets operators run client businesses — including websites, payments, scheduling, CRM, forms, email, SMS, and automations — from a single account. Features available to you depend on your plan and configuration.

2. Accounts & eligibility

You must be at least 18 years old to use the platform. You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity that occurs under your account.

3. Messaging program

The platform offers optional SMS notifications for transactional and account updates. Participation is voluntary, consent is not a condition of purchase, and you may opt out at any time by replying STOP. We will not share phone numbers with third parties for their marketing purposes. 4. Payments & fees

Payments are processed by Stripe. Subscription fees recur until cancelled, and usage-based charges (such as messaging and payment processing) are billed as incurred. Payments collected on behalf of an operator are directed to that operator. Except where required by law, fees are non-refundable.

5. Acceptable use

You agree not to:

  • Use the platform for any unlawful purpose or in violation of applicable laws or carrier rules.
  • Send unsolicited, deceptive, or unlawful messages, or message anyone without the required consent.
  • Attempt to gain unauthorized access to the platform, other accounts, or related systems.
  • Interfere with or disrupt the integrity or performance of the service.

6. Your data & content

You retain ownership of the content and data you provide. You are responsible for its accuracy and for ensuring you have the rights and consents necessary to use it — including the consent required to contact your own customers. You grant us the rights needed to host and process your content to provide the service.

7. Intellectual property

The platform, including its software, design, and trademarks, is owned by Resurgence Cloud LLC and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our intellectual property except the limited right to use the service.

8. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, Resurgence Cloud LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the service.

10. Termination

You may stop using the service at any time. We may suspend or terminate access if you violate these Terms or to protect the platform and its users.

11. Governing law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles.

12. Changes

We may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
